Acceptable Use Policy

This Acceptable Use Policy sets out the terms between you and Youth Leads UK, publisher of Xplode Magazine (“Xplode” or “Youth Leads UK”) under which you may access (the “Website”). This Acceptable Use Policy applies to all users of and visitors to the Website. For the avoidance of doubt, “you” and “your” refer to you as a user of the Website. If you have not done so already, please read this Website’s Terms and Conditions, Privacy Policy, and Cookies Policy.

By continuing to browse the Website, you are accepting and agreeing to abide by all the provisions in this Acceptable Use Policy, which supplement this Website’s main Terms and Conditions. If you do not agree to this Acceptable Use Policy, please do not use the Website. Your continued use of the Website following the posting of any changes to this Acceptable Use Policy will be deemed to be your acceptance of any such changes.

    • You must only use the Website for lawful purposes. You must not use the Website:-

    • You also agree not to:-
      • reproduce, duplicate, copy or re-sell any part of the Website in contravention of the Website Terms and Conditions;
      • access without authority, interfere with, damage or disrupt any part of the Website, any equipment or network on which the Website is stored, any software used in the provision of the Website, or any equipment or network or software owned or used by any third party,
    • Youth Leads UK may from time to time provide interactive services on the Website, including without limitation chat rooms and bulletin boards (“Interactive Services”). Where any Interactive Service is provided on the Website, Youth Leads UK will provide clear information to you about the kind of service offered, whether it is moderated, and what form of moderation is used (including whether it is human or technical).
    • Youth Leads UK will do its best to assess any possible risk for users (and in particular, for children) from third parties when they use any Interactive Service provided on the Website, and Youth Leads UK will decide in each case whether it is appropriate to use moderation of the relevant Interactive Service (including what kind of moderation to use) in the light of those risks. However, Youth Leads UK is under no obligation to oversee, monitor or moderate any Interactive Service provided on the Website, and Youth Leads UK hereby expressly excludes its liability for any loss or damage arising from or in connection with the use of any Interactive Service by a user in contravention of Youth Leads UK’s Content Standards, whether the service is moderated or not.
    • The use of any Interactive Service by a minor is subject to the consent of their parent or guardian. Youth Leads UK advises parents who permit their children to use an Interactive Service that it is important that they communicate with their children about their safety online, as moderation is not foolproof.     • Where Youth Leads UK does moderate an interactive service, Youth Leads UK will normally provide you with a means of contacting the moderator should a concern or difficulty arise.
    • The following content standards (the “Content Standards”) set out in this section 3 of this Acceptable Use Policy apply to any and all material which you contribute to the Website (“Contributions”) and to any Interactive Service associated with such Contributions. You must comply with the spirit and the letter of the Content Standards, which apply to each part of any Contribution, as well as to its whole.
    • Contributions must:
      • be accurate (where they state facts);
      • be genuinely held (where they state opinions);
      • comply with all applicable law in the United Kingdom and in any territory from which they are posted.
    • Contributions must not:
      • contain any material which is defamatory of any person;
      • promote sexually explicit material;
      • promote violence;
      • promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age;
      • infringe any copyright, database right, trade mark, or other intellectual property right of any other person;
      • be likely to deceive any person.
      • be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
      • promote any illegal activity;
      • be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;
      • be likely to harass, upset, embarrass, alarm or annoy any other person;
      • be used to impersonate any person, or to misrepresent your identity or affiliation with any person;
      • give the impression that they emanate from Youth Leads UK, if this is not the case; or
      • advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
    • Youth Leads UK will determine, in its absolute and sole discretion, whether there has been a breach of this Acceptable Use Policy through your use of the Website. When a breach of this policy has occurred, Youth Leads UK may take such action as Youth Leads UK may deem appropriate in its absolute opinion.
    • Your failure to comply with this Acceptable Use Policy constitutes a material breach of the Terms and Conditions upon which you are permitted to use the Website, and may result in Youth Leads UK taking all or any of the following actions:
      • immediate, temporary or permanent withdrawal of your right to use the Website;
      • immediate, temporary or permanent removal of any posting or material uploaded by you to the Website;
      • issue of a warning to you;
      • legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
      • further legal action against you; and/or
      • disclosure of such information to law enforcement authorities as Youth Leads UK considers necessary in its absolute opinion.
    • Youth Leads UK excludes liability for actions taken in response to breaches of this Acceptable Use Policy. The responses described in this policy are not limited, and Youth Leads UK may take any other action that Youth Leads UK deems appropriate in its absolute opinion.
    • Youth Leads UK may revise this Acceptable Use Policy at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you. Some of the provisions contained in this Acceptable Use Policy may also be superseded by provisions or notices published elsewhere on the Website.
